• If a developer or project goes into bankruptcy or receivership, what happens to the existing pre-sale agreements?
• What are the rights and obligations of the trustee/receiver, the unit purchaser, the asset purchaser, the developer, and other parties (i.e. Tarion, HCRA, etc.)?
• How does the Court view these situations, and what will the Court consider when making a decision vis-à-vis termination of pre-sale agreements?
